Terms of Service — Aimour AI App
The honest, plain-English version of the agreement between you and us. Read it. Question it. We're here if anything is unclear.
1. Welcome
These Terms of Service govern your use of Aimour AI App. By creating an account or using the service you confirm that you have read, understood and accepted them.
2. Who can use Aimour AI App
You must be at least 18 years old and legally able to enter a binding contract in your jurisdiction. Accounts that violate this rule are removed.
3. Your account
You are responsible for keeping your login credentials safe. Sharing your account with anyone else is not permitted.
4. Account verification
We may ask you to verify your email, your phone, or your age. Failure to complete verification can result in restricted or paused access.
5. Acceptable use
Aimour is built for personal, non-commercial use. You may not use it to spam, scam, harass anyone, or build a derivative service.
6. Prohibited content
You may not use the service to generate content involving real identifiable minors, real non-consenting individuals, terrorism, or anything illegal in your country.
7. Your content
Anything you write or record inside the app belongs to you. We only store it so the service can work and so you can see it again later.
8. Our content
The Aimour brand, logos, voices, models, code and design are owned by Aimour Studio. You may not copy them outside the app.
9. Your licence to us
You grant us a limited licence to store, process and display your content for the sole purpose of operating the service for you.
10. AI-generated content
Replies generated by your AI companion are produced by a machine. They may be inaccurate, surprising or imperfect — please use judgement.
11. No professional advice
Aimour is not a substitute for medical, legal, mental health or financial advice. For real-world decisions, talk to a qualified professional.
12. Safety features
The app includes gentle wellbeing reminders. If you ever mention self-harm or crisis topics, you will see clear links to professional support resources.
13. Companion behaviour
Each companion follows safety rules and our content policy. We may update those rules to protect users and comply with new regulations.
14. Pricing
Pricing is shown in your local currency where supported. Taxes are calculated and added at checkout according to your billing region.
15. Free plan
The free plan is free forever within its limits. We may adjust those limits with at least 14 days advance notice inside the app.
16. Paid plans
Pro and Soulmate plans are recurring subscriptions. They auto-renew until you cancel them. You can cancel at any time in two clicks.
17. Trials and promotions
If a free trial is offered, it converts to a paid subscription at the end unless cancelled. The exact terms of each promotion are shown at checkout.
18. Refunds
We offer a 7-day no-questions-asked refund on the first paid month of any new subscription. Email billing@aimourai.app to request one.
19. Failed payments
If a payment fails we will try again twice. After the second failure your account is moved back to the free plan without losing your history.
20. Suspension
We may pause or close an account that violates these terms, with notice when reasonable. Severe violations may be acted on immediately.
21. Termination by you
You can close your account at any time from settings. Closing it deletes your data within 30 days, except where law requires us to retain specific records.
22. Termination by us
We may end the service for a user or for everyone with at least 60 days notice, except in cases of fraud, abuse or legal requirement.
23. Service availability
We aim for 99.9% monthly uptime but cannot promise the service will always be available. Planned maintenance is announced in advance.
24. Beta features
Some features are labelled as beta. They may change, break or disappear without notice. Use them in that spirit.
25. Updates to the service
We may add, change, or remove features as the product evolves. We will not silently remove anything you paid for during your billing period.
26. Third-party services
The app may link to third-party content, payment processors or app stores. Their own terms apply to your interactions with them.
27. User feedback
If you send us ideas, you allow us to use them to improve the product without owing you compensation or attribution.
28. Indemnification
You agree to defend us against any third-party claim caused by your misuse of the service or by content you generate that violates these terms.
29. Disclaimers
The service is provided "as is" without warranties of any kind, except those that cannot legally be excluded in your jurisdiction.
30. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim related to the service is limited to the amount you paid us in the last 12 months.
31. Force majeure
We are not liable for failures caused by events outside our reasonable control — natural disasters, war, sanctions, internet outages and similar.
32. Governing law
These terms are governed by the laws of Portugal. Mandatory consumer protections of your home country still apply where they are stronger.
33. Dispute resolution
Most issues can be resolved by writing to legal@aimourai.app. Where that fails, EU consumers can use the European Online Dispute Resolution platform.
34. Class action waiver
Where permitted by law, you agree to bring claims individually and not as part of a class action against Aimour.
35. Changes to these terms
We may update these terms occasionally. Material changes are communicated by email and in-app at least 14 days before they take effect.
36. Notices
Legal notices to us must be sent to legal@aimourai.app with a copy to our registered address in Lisbon.
37. Severability
If any clause of these terms is found invalid, the rest stays in full force and effect.
38. Entire agreement
These Terms, together with our Privacy Policy, are the entire agreement between you and Aimour AI App regarding the service.
